The Supreme Court today declared as unconstitutional the dissolution of Bihar Assembly on the basis of the controversial report of Governor Buta Singh.
However, a Constitution bench headed by Justice Y K Sabharwal said that the status quo ante will not prevail and the election to the Bihar Assembly will go as per the schedule.
Today's order means that the dissolved assembly will not be revived. In the majority judgement, the bench said, "the proclamation of May 23 dissolving the Assembly is unconstitutional.
